Trademark & Brand Protection Policy – NIVITA HUF

This Trademark Policy governs the ownership, permitted use, and protection of the OMWEB name, logo, and associated brand assets.

1. Trademark Ownership

OMWEB is a protected brand and trademark owned and operated by NIVITA HUF, India.

Trademark applications for “OMWEB” have been filed under the Trade Marks Act, 1999 (India), including applications in Class 42, under the following application numbers:

  • 5554228

All rights, title, and interest in the OMWEB name, logo, platform identity, and related marks are exclusively reserved by NIVITA HUF.

2. Scope of Trademark Protection

The OMWEB trademark includes, but is not limited to:

  • The wordmark “OMWEB”
  • OMWEB logos, visual identity, and branding
  • Platform names, service identifiers, and digital properties
  • Associated domain names and subdomains

3. Permitted Use

Limited, non-commercial reference to OMWEB may be allowed where:

  • No confusion or misrepresentation is created
  • No endorsement or partnership is implied
  • The use is factual, descriptive, and non-deceptive

Any commercial, promotional, or branding use of the OMWEB name or logo requires prior written authorization from NIVITA HUF.

4. Prohibited Use & Infringement

The following actions are strictly prohibited and may constitute trademark infringement:

  • Domain Name Abuse: Registering, using, or trafficking domains containing “OMWEB” or confusingly similar variations.
  • Business Name Misuse: Using “OMWEB” in company names, product names, or services without authorization.
  • False Association: Claiming or implying affiliation, partnership, or endorsement by NIVITA HUF.
  • Social Media Misuse: Using “OMWEB” in usernames, handles, or branding without permission.
  • Misleading Marketing: Any use that creates confusion or dilutes the OMWEB brand.

5. Enforcement & Legal Action

OMWEB actively monitors and enforces its trademark rights. Enforcement actions may include:

  • Cease-and-desist notices
  • Domain disputes (including INDRP / UDRP proceedings)
  • Platform takedown requests
  • Civil and criminal remedies under applicable law

6. Reporting Trademark Violations
